These Terms and Conditions (“Terms”) govern your use of the Fast Print Austin website located at fastprintaustin.com (the “Site”) and your purchases of products from us. By accessing or using our Site and placing an order, you agree to be bound by these Terms. If you do not agree to all of these Terms, please do not use the Site.

Fast Print Austin is a print-on-demand service. This means that the products you see on our Site are not held in stock but are printed and manufactured specifically for you once you place an order.

1. GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (excluding credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission by us.

2. PRODUCT DESCRIPTIONS & CUSTOM DESIGNS

We strive to display our colors, designs, and products as accurately as possible. However, we cannot guarantee that your monitor’s display of any color will be accurate.

For custom or personalized products:

You are responsible for ensuring the accuracy of the design, text, and images you upload.
You represent and warrant that you own the rights to any image, logo, or design you upload. You agree not to upload any content that infringes on any third-party copyright, trademark, or other intellectual property rights.
We reserve the right to refuse any order that we suspect may violate intellectual property laws or contain offensive, defamatory, or prohibited content.

3. ORDERS, PRODUCTION & SHIPPING

Order Acceptance:
Your placement of an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available, inaccuracies in product descriptions, or suspicion of fraud.

Production Time:
Because all products are made-to-order, please allow 2-5 business days for production before your order ships. This is in addition to shipping transit times.

Shipping Times:
Shipping times are estimates and commence from the date of shipping, not the date of order. We are not responsible for delays caused by the shipping carrier or customs clearance processes. Shipping costs and delivery estimates are provided at checkout.

Shipping Address:
You are responsible for providing an accurate shipping address. We are not responsible for orders delivered to an incorrect address provided by you. If a package is returned to us due to an incorrect address, you will be responsible for the cost of re-shipping.

4. RISK OF LOSS & TITLE

All items purchased from our Site are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the shipping carrier. Once the item is in the hands of the carrier, any claims for lost or damaged items must be handled through the carrier’s claims process, though we will assist you as best we can.

5. RETURNS, REFUNDS, AND EXCHANGES

Due to the custom, made-to-order nature of our products, we generally do not accept returns or exchanges unless the product is defective or damaged.

Damaged/Defective Items:
If you receive a defective or damaged product, you must contact us within 2 days of delivery. Please provide your order number, a description of the issue, and clear photographs of the damage/defect. We will review the issue and, at our discretion, offer a replacement or a refund.

Incorrect Items:
If you receive the wrong item (e.g., wrong size, wrong design), please contact us immediately with your order number and a photo of the item received.

Non-Returnable Items:
We cannot accept returns for:

Items that are correctly made but no longer wanted (e.g., wrong size ordered, changed mind).
Items that have been washed, worn, or altered.

Refunds:
Approved refunds will be processed back to your original payment method within 5-10 business days. Please note that original shipping costs are non-refundable.

6. INTELLECTUAL PROPERTY RIGHTS

All content on this Site, including but not limited to text, graphics, logos, button icons, images, and software, is the property of Fast Print Austin or its content suppliers and is protected by international copyright laws.

The use of our trademarks or trade dress is prohibited without our prior written consent.

7. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

Disclaimer of Warranties:
We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. The service and all products are provided on an “as is” and “as available” basis without any representations or warranties of any kind, either express or implied.

Limitation of Liability:
To the fullest extent permitted by law, Fast Print Austin shall not be liable for any indirect, incidental, punitive, or consequential damages arising out of or in connection with your use of the Site or products purchased, even if advised of their possibility. In jurisdictions that do not allow the exclusion or limitation of liability, our liability shall be limited to the maximum extent permitted by law.

Because Fast Print Austin is a print-on-demand retailer, we rely on third-party printers. Therefore, our total liability to you for any claim arising from a product order shall be limited to the purchase price of that product.

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Fast Print Austin and our parents, subsidiaries, affiliates, partners, officers, directors, agents, contractors, and employees from any claim or demand made by any third-party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third-party (including, without limitation, copyright or trademark infringement related to designs you upload).

9. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Texas , without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Travis County, Texas .

10. CHANGES TO TERMS

We reserve the right to update, change, or replace any part of these Terms at any time. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Site following the posting of any changes constitutes acceptance of those changes.
